Si un travailleur a occup\u00e9 un emploi continu chez le m\u00eame employeur pendant au moins trois ans, un pr\u00e9avis d&#8217;au moins trois mois doit \u00eatre donn\u00e9. Des d\u00e9lais de pr\u00e9avis plus courts sont prescrits dans tous les autres cas. Si l&#8217;employ\u00e9 est r\u00e9mun\u00e9r\u00e9 \u00e0 des intervalles mensuels ou bimensuels, il doit donner un pr\u00e9avis d&#8217;au moins 14 jours avant la fin d&#8217;un mois civil; Si le travailleur est r\u00e9mun\u00e9r\u00e9 \u00e0 des intervalles de moins de 14 jours, la dur\u00e9e de l&#8217;avis doit \u00eatre au moins \u00e9gale \u00e0 l&#8217;intervalle auquel la r\u00e9mun\u00e9ration est vers\u00e9e.<\/p>\n\n\n\n<p>Aucun avis n&#8217;est requis lorsque le cong\u00e9diement est pour faute grave. Un cong\u00e9diement pour faute est permis si l&#8217;employeur ne pouvait, de bonne foi, suivre une autre voie que de cong\u00e9dier l&#8217;employ\u00e9 et que le cong\u00e9diement ait \u00e9t\u00e9 effectu\u00e9 dans les sept jours suivant l&#8217;un ou l&#8217;autre des \u00e9v\u00e9nements suivants, selon le cas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;ach\u00e8vement d&#8217;une audience devant le comit\u00e9 de discipline de l&#8217;entreprise impliquant l&#8217;employ\u00e9;<\/li>\n\n\n\n<li>Jugement final prononc\u00e9 \u00e0 l&#8217;encontre de l&#8217;employ\u00e9 dans le cadre d&#8217;une proc\u00e9dure p\u00e9nale \u00e0 la demande de l&#8217;employeur, ou<\/li>\n\n\n\n<li>La faute de l&#8217;employ\u00e9 doit d&#8217;abord \u00eatre signal\u00e9e \u00e0 l&#8217;employeur.<\/li>\n<\/ul>\n\n\n\n<p>Un employeur qui compte au moins dix travailleurs et qui a l&#8217;intention de r\u00e9duire le nombre de travailleurs de fa\u00e7on temporaire ou permanente doit donner un avis \u00e9crit de ces intentions au ministre du Travail, accompagn\u00e9 d&#8217;un expos\u00e9 des motifs de la r\u00e9duction d&#8217;au moins 120 jours, avant la date d&#8217;entr\u00e9e en vigueur de la cessation d&#8217;emploi. Le ministre doit renvoyer l&#8217;affaire \u00e0 la fin des contrats de service. L&#8217;employeur ne peut r\u00e9duire le nombre d&#8217;employ\u00e9s avant que 120 jours se soient\u00e9coul\u00e9s depuis la remise de l&#8217;avis au ministre ou jusqu&#8217;\u00e0 ce que la Commission rende sa d\u00e9cision selon la derni\u00e8re \u00e9ventualit\u00e9.<\/p>\n\n\n\n<p>Sauf en cas de licenciement pour faute lourde, l&#8217;employeur doit verser une indemnit\u00e9 de d\u00e9part \u00e0 tout employ\u00e9 ayant 12 mois ou plus de service continu si l&#8217;employeur met fin \u00e0 son emploi ou s&#8217;il prend sa retraite \u00e0 l&#8217;\u00e2ge de 60 ans ou apr\u00e8s, volontairement ou \u00e0 la demande de l&#8217;employeur. Si la cessation d&#8217;emploi par un employeur est justifi\u00e9e, l&#8217;indemnit\u00e9 de d\u00e9part payable \u00e0 l&#8217;employ\u00e9 est normalement \u00e9gale au quart du salaire mensuel pour chaque p\u00e9riode de 12 mois de service, et si injustifi\u00e9, 3 mois de salaire pour chaque 12 mois de service. Dans les cas o\u00f9 la main-d&#8217;\u0153uvre est r\u00e9duite, la d\u00e9cision du Conseil de cessation des contrats de service d\u00e9terminera si la cessation d&#8217;emploi est justifi\u00e9e ou non.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L&#8217;avis d&#8217;intention de mettre fin \u00e0 l&#8217;emploi peut \u00eatre verbal ou \u00e9crit.
